Provide accurate, complete, and current registration information
Maintain the security of your password and accept responsibility for all activity under your account
You are responsible for ensuring that all information you provide is truthful and up to date. 4. Employer Obligations
As an employer using the Platform, you agree to:
4.1 Legal Compliance
Comply with the Hong Kong Employment Ordinance (Cap. 57) and the Standard Employment Contract (Form ID407) for foreign domestic helpers

Provide adequate accommodation, meals (or food allowance of HK$1,236/month), medical coverage, and a return air ticket as required by law
Not deduct placement or agency fees from the helper's salary — this is a criminal offence
4.2 Platform Use
Use helper profile data solely for the purpose of evaluating candidates for domestic employment — not for any other purpose
Conduct all communication through the Platform's secure messaging system until placement is confirmed
Not share helper personal data (photos, contact details, documents) with any third party
Treat all helpers with dignity and respect in accordance with Hong Kong law
Not discriminate on grounds of race, nationality, or religion in violation of the Race Discrimination Ordinance (Cap. 602)
Not confiscate a helper's passport or identity documents (illegal under HK law)
5. Domestic Helper Obligations
As a domestic helper using or listed on the Platform, you agree to:

Maintain the currency and accuracy of your profile and notify us of any changes immediately
Not create multiple profiles or misrepresent your identity, skills, or availability
Comply with Hong Kong Immigration Ordinance (Cap. 115) — including visa conditions and the two-week rule when applicable

Not charge helpers recruitment fees — any violation will result in immediate Partner Portal suspension and referral to the Labour Department
Maintain data protection standards equivalent to those in our Privacy Policy for all helper data accessed via the Portal
7. Acceptable Use
You agree NOT to:
Use the Platform for any unlawful purpose or in violation of any applicable law or regulation
Scrape, copy, or harvest data from the Platform by automated means or without our express written consent

All fees are quoted and payable in Hong Kong Dollars (HKD) unless otherwise stated

8.4 No Fee Deduction from Helpers
Employers are expressly prohibited from deducting any Platform fee, agency commission, or service charge from a helper's salary. Violation of this clause is a criminal offence under the Employment Ordinance and will result in immediate account termination and referral to the Commissioner for Labour.
9. No Guarantee of Placement
SeekHelpers does not guarantee that any employer will successfully hire a helper, that any helper will secure employment, or that any visa application will be approved. Immigration decisions rest solely with the Hong Kong Immigration Department and the relevant home-country authority. We act as a facilitator and documentation service only.
While we strive to verify all helper credentials, we cannot guarantee the accuracy of third-party documents, reference letters, or self-reported information. Employers are encouraged to conduct their own due diligence before signing any Standard Employment Contract.
10. Intellectual Property
All content on the Platform — including the SeekHelpers brand, logo, design, code, AI matching algorithm, marketing copy, and aggregated data insights — is the exclusive intellectual property of SeekHelpers Global Recruitment Limited and is protected by Hong Kong copyright law and international treaties.
You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Platform for its intended purpose. This licence does not permit you to reproduce, modify, distribute, publicly display, or create derivative works from any Platform content without our express written consent.
User-generated content (including helper profile information, photos, and videos) remains the intellectual property of the user. By uploading content, you grant SeekHelpers a limited licence to display, store, and process that content solely for the purpose of operating the Platform.
11. Data Privacy
Our collection, use, and protection of personal data is governed by our Privacy Policy, which forms part of these Terms. Key points:
We comply with the Hong Kong Personal Data (Privacy) Ordinance (Cap. 548)
Sensitive data (HKID, passport numbers, medical certificates) is encrypted at rest and masked in the user interface
We do not sell personal data to third parties for their marketing purposes
Users may request access, correction, or deletion of their data at any time (subject to statutory retention obligations)
12. Limitation of Liability
To the fullest extent permitted by Hong Kong law:
SeekHelpers Global Recruitment Limited's aggregate liability to you for any claim arising out of or related to your use of the Platform shall not exceed the greater of: (a) the total fees paid by you to SeekHelpers in the 12 months preceding the claim; or (b) HK$5,000.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profit, loss of data, or reputational harm, even if we were advised of the possibility of such damages.
We are not liable for the conduct, acts, or omissions of any employer, helper, or agency partner on the Platform.
We are not liable for any decision by the Hong Kong Immigration Department, POEA, or any other government authority in relation to visa or work permit applications.
We are not liable for any breach of the Standard Employment Contract between employer and helper.
Nothing in these Terms limits our liability for fraud, gross negligence, wilful misconduct, or any liability that cannot be excluded by law.
13. Indemnification
You agree to indemnify and defend SeekHelpers Global Recruitment Limited, its directors, officers, employees, and agents from and against any claims, losses, damages, costs, and expenses (including reasonable legal fees) arising directly from: (a) your breach of these Terms; (b) your violation of any applicable law or regulation; or (c) your infringement of any third party's rights.
This indemnification obligation is subject to the liability cap in Section 12. You will not be liable to indemnify us for losses caused by our own negligence or wilful misconduct.
14. Termination
14.1 Termination by You
You may delete your account at any time through the Platform settings. Deletion requests are processed within 30 days. Data subject to statutory retention obligations will be retained as set out in our Privacy Policy.
14.2 Termination by Us
We may suspend or terminate your account immediately, without notice, if:
You breach any provision of these Terms
We reasonably suspect fraudulent or illegal activity
Continued access poses a risk to the safety of helpers, employers, or our platform
We are required to do so by law or a competent authority
For non-urgent violations, we will typically provide a 14-day cure period before termination.
14.3 Effect of Termination
On termination, your right to use the Platform ceases immediately. Any pending visa applications already in progress will be completed or handed off with reasonable notice. Provisions that by their nature should survive termination (including Sections 10, 11, 12, 13, 15, and 17) shall do so.
15. Dispute Resolution
If you have a complaint about our services, please contact us first at support@seekhelpers.com. We aim to resolve all complaints within 14 business days.
If we cannot resolve the dispute informally, either party may refer the matter to:
The Small Claims Tribunal (for claims not exceeding HK$75,000)
The Labour Tribunal (for employment-related disputes)
Mediation or arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) (for higher-value commercial disputes)
Nothing in this clause prevents either party from seeking urgent injunctive relief from any competent court.
16. Changes to These Terms
We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of any material changes via email and an in-app notification. Your continued use of the Platform after the effective date of any updated Terms constitutes your acceptance of the changes.
The current version of these Terms is always available at seekhelpers.com/terms-and-conditions.
17. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to conflict of law principles.
You irrevocably submit to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region for the resolution of any dispute arising out of or in connection with these Terms, save that SeekHelpers reserves the right to seek injunctive or other equitable relief in any competent jurisdiction.
